Apple Responds To Siri Class Action Lawsuit

Apple is defending Siri against a would-be class action lawsuit claiming the personal assistant in the iPhone 4S doesn’t work as advertised.

According to The Wall Street Journal, the lawsuit claims that Apple’s ads for Siri are false advertising, claiming that the service doesn’t work as Apple says it does. Apple’s response is that Siri is a Beta product and users were able to return the iPhone 4S within 30 days if dissatisfied with its performance.

One of the plaintiffs seeking class action status claims they were unable to replicate Apple’s Rock God commercial. Another said Siri couldn’t understand when he asked it for directions to certain locations. According to the second plaintiff, when Siri did understand, it responded with the wrong answer.

According to Apple’s lawyers the plaintiffs didn’t explain how the ads are misleading, or how their personal experiences with the virtual personal assistant relate to the ads.

Part of Apple’s move for dismissal reads:

They offer only general descriptions of Apple’s advertisements, incomplete summaries of Apple’s website materials, and vague descriptions of their alleged—and highly individualized—disappointment with Siri. Tellingly, although Plaintiffs claim they became dissatisfied with Siri’s performance “soon after” purchasing their iPhones, they made no attempt to avail themselves of Apple’s 30-day return policy or one-year warranty—which remains in effect. Instead, they seek to take an alleged personal grievance about the purported performance of a popular product and turn it into a nationwide class action under California’s consumer protection statutes. The Complaint does not come close to meeting the heavy burden necessary to sustain such claims.

Apple’s response basically boils down to: users who aren’t satisfied with the iPhone 4S are free to return it if they are unhappy, and the plaintiffs don’t make valid arguments.

None of Apple’s commercials for Siri from the aforementioned Rock God ad to the new ones featuring Samuel L. Jackson mention that Siri is a Beta product. Siri is only labelled as a Beta on Apple’s website.

However, despite the Beta moniker we’re able to replicate everything from the commercials with the exception of the guitar tabs in Rock God, simply because we can’t figure out what the boy said to get his Wolfram Alpha result.
