When Will Technology Be Included In Back To School Sales Tax Holidays?

- Warner Crocker

I’m writing this only with knowledge of my state, Virginia, hoping others from other states will fill in if info is different where they live. Today begins Virginia’s Back to School Sales Tax Holiday, where certain school supplies and clothing are exempt from state sales tax. It is usually a big shopping weekend.

Other states do this as well. Intriguingly when it comes to school supplies, the item has to cost under $20 and there are no exemptions on computer hardware and software. “School Supply” is defined as an item commonly used by a student in the course of study. There is a published list of what’s exempt, and dealers are allowed to not charge sales tax on other items, but they then have to absorb that cost on pay the sales tax on those items.

So, what does your state do? Does it have a sales tax holiday? Does it include technology in its list of exempt purchases?

In MA the sales tax holiday includes technology up to $2,500. Everyting except boats, cars and meals and tobacco products are excluded, as are telecommunication services and gas, steam and electric utilities. Not bad for taxachusetts.

Here's the list for Missouri

The sales tax exemption is limited to:
Clothing - any article having a taxable value of $100 or less
School supplies - not to exceed $50 per purchase
Computer software - taxable value of $350 or less
Personal computers - not to exceed $3,500
Computer peripheral devices - not to exceed $3,500

The reason VA has kept it to a low limit and not on technology is because too many people would be taking advantage of it for non academic purposes. Working at an OD in VA, countless people have said they would wait until the weekend to get the tax exemption on electronics, when they clearly have no intention of ever doing any academic work with it.

Oklahoma has a pretty restrictive list, although I would love to see technology added to this as many schools are requiring expensive calculators for higher-level math.

"Sales of any article of clothing or footwear designed to be worn on or about the human body and the sales price of the article is less than one hundred dollars ($100) are exempt. This does not apply to the sale of any accessories, special clothing or footwear primarily designed for athletic activity or protective use that is not normally worn except when used for athletic activity or protective use, or to the rental of clothing or footwear."

In Tennessee, our sales tax holiday covers clothes $100 or less, school supplies $100 or less and computers $1500 or less.

Minnesota has NOT tax holiday.

However, for a state that LOVES taxes, MN has never taxed clothing...must be due to their Scandineuvian nature.
