Apple Threatens To Block Samsung Galaxy S III With Restraining Order

Apple’s lawyers are threatening Samsung with a temporary restraining order to block the Galaxy S III U.S. release later this month.

According to 9To5Mac, Apple lawyer Josh Krevitt said the company could file the temporary retraining order as early as today. This comes just after Apple filed a motion to include the Samsung Galaxy S III in its preliminary injunction against the Samsung Galaxy Nexus. Samsung’s lawyers recommended the judge throw out the motion before Krevitt threatened with the temporary restraining order.

Krevitt said the temporary restraining order will create “a mechanism to allow the court to decide this issue before the launch.” If Apple simply filed a new preliminary injunction it would have to wait until after the launch of the device.

Before Apple files the temporary restraining order Samsung must prove the Galaxy S III has a” different combination of features” from the Galaxy Nexus. That would prevent Apple from including the Galaxy S III in the injunction, at which point Krevitt will likely issue the temporary restraining order.

According to Bloomberg, Samsung lawyer Bill Price claims Apple is trying to block the Galaxy S III before launch because Apple can’t “compete against new features.” Price said Apple wants to “prevent a phone from getting to the public that’s better than Apple’s in many, many respects.”

We believe claiming that one of the phones in question is purely subjective based on the user’s wants. We do, however, think Apple has good reason to go after the Galaxy S III by saying it violates Apple’s patent on Siri. S Voice clones almost everything about Siri, right down to the UI.

The court date for the preliminary injunction against the Galaxy Nexus is July 30, though a temporary restraining order might delay it.

Apple is also actively trying to ban the sale of 29 HTC devices for patent infringement even after Customs said the HTC One X and EVO 4G LTE didn’t infringe on the company’s patents.

I like Apple and Android but this is ridiculous. Apple has spent little to no time creating anything new since the first iPhone. I wish they would put their efforts towards outdoing Android instead of suing Samsung and other manufacturers when they actually do something new. This is really pathetic and I can’t see how anyone would see it any other way.

Thank you for stating this. You and I think the same.

Wow… I must say Apple’s behavior here is really disappointing. This reminds me of Microsoft from the mid 90’s when they would sue other OEMs for selling PCs without a Windows OS, and or force them via contract to Pay for a Windows License whether or not they sold a PC with or without a Windows OS. Anyone else remember this? (this was before the IE integration of Windows). Microsoft began getting a lot of very bad news publicity and people’s opinion of the company began to be very negative and it stayed that way for 10 plus years. If Samsung, Google, and HTC were smart, they would begin working the press and do the same thing to Apple. At this point, it’s not a matter of who has a better product or what patient is being infringed upon, but more to the average lamin, that Apple is doing the same tactics that Microsoft was doing and is preventing Apple from letting other companies compete. The negative PR would be devastating to Apple and their Sheeple customers(people who follow the flow like sheep) who believe Apple is Jesus Christ but in the form of a company.
