Samsung Fights for Your Right to Use the Galaxy Tab 10.1

Apple may have won the first legal battle in Germany, but the Cupertino company isn’t going to win the way just yet.

After a judge in Düsseldorf granted an injunction prohibiting the sale of the Galaxy Tab 10.1 in most of the European Union, Samsung has said that the company will fight the injunction.

The South Korean company has a court date of August 25th for a judge to hear the appeal argument. Until the judge rules otherwise, Samsung cannot sell the Galaxy Tab 10.1 in the EU, except for the Netherlands. Apple has also won cases in Australia and is arguing in the U.S.

If Samsung continues to sell the Samsung Galaxy Tab 10.1 in the EU it could be fined $350,000 per device. Interestingly enough, it appears that some retailers in the EU still have the galaxy Tab 10.1 on their shelves.

According to Apple, the Samsung Galaxy Tab copies the design and user interface of the iPad. Apple also claims that in a survey of consumers, 80% couldn’t tell the difference between the iPad and the Galaxy Tab.

We’ve already covered why Apple is scared of the Galaxy Tab, giving even more reason for the company to pick out the top competition to halt sales with lawsuits.

The scary thing for consumers is that Apple’s patent is quite broad, perhaps covering all tablets with a screen, bezel and in a rectangular-ish shape. That’s right, if Samsung doesn’t “fight for your right to tablet!” Apple might keep going and take out the competition.

Until this shakes out, Samsung is in for a bumpy ride. As someone who appreciates competition in the tablet space, I hope a judge rules in the favor of Samsung.

    “Your honor, Chevrolet has stolen our design.  The Model T has four tires, a steering wheel, and a windshield.  Chevrolet has stolen  this design and all sales must be halted.”  

    Judge laughs all the way to Dusseldorf.

    Competition is a positive thing, Mr. Jobs.  Beware the anger of the consumer.

    Last time I looked, Apple hadn’t said anything against your right to Tab — although a patent might cover that.  Apple got an injunction against Samsung.
